Sub: Regarding payment of Allowances to PS Group “B” officers whose grade pay
(1) The place any workmen is suspended by the employer pending investigation or inquiry into complaints or cost of misconduct towards him, the employer shall pay to such workman subsistence allowance-
(a) on the fee of fifty per cent of the wages which the workman was entitled to right away previous the date of such suspension, for the primary ninety days of suspension; and
(b) on the fee of seventy-five percent of such wages for the remaining interval of suspension if the delay in the completion of disciplinary proceedings towards such workman isn’t straight attributable to the conduct of such workman.
(2) If any dispute arises concerning the subsistence allowance payable to a workman beneath sub-section (1) the workman or the employer involved might refer the dispute to the Labor Court docket, constituted under the Industrial Disputes Act, 1947 (14 of 1947), inside the native limits of whose jurisdiction the economic institution whereby such workman is employed is situated and the Labor Court docket to which the dispute is so referred shall, after giving the events a chance of being heard, determine the dispute and such choice shall be ultimate and binding on the events.
